Investigating a derailment typically requires reviewing track inspection records, maintenance logs, and the railroad's own internal safety protocols to determine what went wrong — and who is responsible. In many serious derailments, the National Transportation Safety Board (NTSB) conducts an independent federal investigation, and its findings, while not always directly admissible, often shape the evidence available in a subsequent civil claim.
Positive Train Control
Since the Rail Safety Improvement Act of 2008, federal law has required Positive Train Control (PTC) systems on roughly 60,000 miles of track nationwide — technology specifically designed to prevent train-to-train collisions, over-speed derailments, and unauthorized incursions into work zones by automatically slowing or stopping a train if the engineer fails to do so in time. When a derailment or collision occurs on a PTC-equipped line, whether the system was installed, functioning, in active service, and properly maintained at the time of the incident can be a critical liability question. If PTC should have prevented an accident but failed to, that failure — and why it failed — often becomes central to the case.
Railroad Crossing Accidents

Amtrak is a quasi-governmental entity — created by federal law but operated as a for-profit corporation — and claims against it can involve unique procedural and jurisdictional questions that don't arise in a claim against a purely private freight railroad. Freight rail cases, meanwhile, often involve interstate carriers whose operations, equipment, and safety practices are governed almost entirely by federal law, which can affect where and how a case is properly filed.
FELA: When the Injured Person Is a Railroad Worker
If the injured person is a railroad employee rather than a passenger or third party, the case is generally governed by a different law entirely: the Federal Employers' Liability Act (FELA), enacted by Congress in 1908. Unlike ordinary state workers' compensation systems, which pay set benefits regardless of fault but limit an injured worker's recovery, FELA requires the injured worker to prove the railroad was negligent — but in exchange, allows the worker to pursue full damages, including pain and suffering, rather than the capped benefits typical of a standard workers' compensation claim. This is an important distinction: a railroad worker injured on the job generally cannot pursue a standard personal injury claim the way a passenger could, but FELA provides its own, often more favorable, path to compensation.
Federal Preemption and Jurisdiction
Because railroads operate under extensive federal regulation, questions of federal supremacy and preemption — whether federal law overrides or limits a state law claim — come up frequently in train accident litigation.
